The Organic Law for Improving the Educational Quality (LOMCE): a contested reform with limited horizon
Abstract
This paper analyzes the Spanish educational reformof 2013, based on new principles of LOMCE that qualify the old principle of inclusive education which however continues to restrict academic freedom in private schools with public funding. At the same time, this principle is limited by the recognition of this schools´ right to make a different offer based on single sex education.
Moreover, this reform strengthens the dispersal of Spanish education system, divided by 17 autonomous communities, with less than 50% uniformity. Also, it does not clarify the scope of education as public service, missing the opportunity to refine the legal framework for private schools with public funding. Isabel María de los Mozos y Touya
